MESSAGE FROM PRESIDENT JOSEPH M. PACELLA

I sincerely hope to see all of you at the annual meeting and vendor show on June 13th.  For the two hundred or so who will attend, please come early and take advantage of the many member benefits showcased by the vendors who underwrite the cost of the dinner.  There are some real savings that will benefit any practice of any type or size.

I wanted to take some time to thank everyone who contributed and/or collected food for the Attorney General’s Legal Food Frenzy challenge this year.  We are waiting to hear how Hampden County placed.  I know that I speak for the Board and Noreen when I tell you how touched we were to see the tremendous amount of food that was brought to our office from almost every clerk’s, probation, registry, and the law library across the county.  This resulted in over 658 pounds of food and $2,266.00 in monetary donations which is equivalent to 9,722 pounds of food being collected in a very short period of time.  Your efforts will help to provide literally thousands of meals to those in need in our county during a time when funding  for these and other worthwhile causes is scarce. 

Lawyers, especially our members, are some of the most compassionate and giving members of our society.  Many of you have volunteered this year to provide assistance to pro se individuals across our many courts in HCBA projects alone, totaling many hundreds, if not thousands of hours of pro bono advice.  Moreover, many of you have contributed or helped to raise money to provide legal services to those in need through the Western Massachusetts Justice Campaign 2013 for Community Legal Aid and Massachusetts Justice Project.    In addition to addressing the funding crisis that Community Legal Aid and Massachusetts Justice Project have been facing, the long-term goal of the Campaign is to become the primary focus for charitable giving among attorneys and judges in central and western Massachusetts.  And, because the entire community has a stake in guaranteeing access to the justice system, another important goal is to involve the broader community in building and sustaining the Campaign.  This is a great and worthy cause, so if you have not already, please consider making a donation today.  To do so, you can contact Christina M. HCBA ELECTIONS & OFFICE NEWS

The ballot for President-Elect and Board of Directors for the upcoming year has been mailed  to all eligible voting members of the Hampden County Bar Association. The office of the Hampden County Bar Association must receive this Ballot in the enclosed envelope no later than 4:00 p.m. Monday, June 10, 2013. Pursuant to HCBA bylaws, ballots received later than that date and time will not be counted.

New Phone System

The Hampden County Bar Association office is switching over to a new phone system next week.  We will be transitioning our traditional phone number of 413-732-4648 to be exclusively for the Lawyer Referral & Information Service.  You will still be able to access member services through that number, but the more direct number for members is 413-732-4660.  If you have any problems getting through to our office over the next week, please send an email to admin@hcbar.org.

PRACTICE DEVELOPMENT SERIES

The Practice Development Series  discusses "Real Life Lawyering". The series objective is to support lawyers, particularly new practitioners, solo practitioners and members of small firms, to improve professional skills, increase collegiality and decrease the business, liability ethical and health risks of practice. The next Real Estate Section lunch will be held on Tuesday, June 11, 2013 at Red Rose Pizzeria at 12:00 p.m.   First American Title Insurance Company will talk about "changing the way mortgage loans will be made after January 2014".   Ruth Dillingham will speak about the CFPB's recent rule making, and how it affects closing attorneys and their clients.  While the CFPB has not yet made rules about RESPA and TILA forms, it has been busy at work changing the way mortgage loans will be made after January 2014.  This program will look at those rules as they affect residential mortgage loan conveyancers and their clients, both lender and borrower.

BANKRUPTCY SECTION

The Bankruptcy Section held a lunch on  May 20, 2013, which was attended by over 30 attorneys.  The guest speaker was Richard P. Finkel, partner of Blum Shapiro, an accounting, tax and business consulting firm, who spoke about "Dealing with Tax Issues in Bankruptcy".  We appreciate him taking time out of his busy schedule to present this valuable information.  Watch for more details for the next Bankruptcy Section lunch.


PROBATE & FAMILY COURT

The next Probate Court Bench Bar meeting will be held on Thursday, July 18, 2013 at 4:00 p.m.  The agenda for the meeting will be sent to all members prior to the meeting.  If you have any questions or would like to add a topic to the agenda, please contact the HCBA at 732-4648 or admin@hcbar.org.

Volunteer Opportunities

The Probate Court Bench Bar Sub-Committee on Volunteer Opportunities has developed a calendar that gives a brief description of the various volunteer programs, along with the dates that volunteers are needed in the Probate & Family Court. The programs include Conciliation and LAR/Lawyer for the Day opportunities.

Pre-Trial Conference Program

The Probate Pre-Trial Conference Program is a great pro bono opportunity for attorneys to offer their services in the Probate Court. Sessions are held every other Tuesday with an occasional Thursday.  We’d like to thank the following individuals who volunteered for Thursdays in May:

DISTRICT COURT

The next District Court bench bar meeting is scheduled for Monday, June 24, 2013.   Discussion on potential Arraignment Session from 4:30 - 7:00pm, once or twice a month, starting next Fall.  Primarily targeting Chapter 90 criminal motor vehicle cases.   Civil Commitments-View from the Clerk’s Office.  District Court Updates-View from the DA’s office.  If anyone has any  additional topic areas or suggestions, please contact mrooke@dwpm.com or bryan@dwpm.com.

Lawyer for the Day-District Court

The Lawyer for the Day program continues to be a success due to the many volunteers who have offered their services in District Court on Wednesdays and Thursdays. HCBA ARBITRATION/MEDIATION SERVICE

The Hampden County Bar Association Arbitration & Mediation Service maintains a roster of highly qualified lawyers and retired judges for arbitration, mediation, or case evaluations. Our panel members, as an accommodation to the Bar Association, have agreed to serve at substantially reduced rates for arbitrations, mediations or case evaluations. Indeed, many of our panel members independently mediate and arbitrate cases at higher rates. Why not conserve resources by coordinating your arbitrations or mediations through the Hampden County Bar Association? We encourage you to support your bar association by keeping the Arbitration and Mediation Service in mind for alternative dispute resolution. LAWYER REFERRAL & INFORMATION SERVICE

The Hampden County Bar Association's Lawyer Referral & Information Service (LRIS) meets American Bar Association standards for lawyer referral and has a Reduced Rate Panel. Anyone interested in participating in the lawyer referral program can contact our office at 413-732-4648 or via email at lawyerreferral@hcbar.org. Within the last month, attorneys have submitted over $2,970.00 in LRIS referral percentage payments a result of over $19,800.00 in client fees.

If you receive a call from a potential client looking for assistance in an area of law that you do not practice, why not refer them to the Hampden County Bar Association's Lawyer Referral & Information Service? All members of the LRIS are your experienced colleagues. Support your LRIS in providing quality referrals in our community!

HAMPDEN COUNTY LEGAL CLINIC

On Saturday, October 19, 2013, the Lawyer Referral & Information Service and Hampden County Legal Clinic, in conjunction with Springfield City Library, will hold a public Question & Answer forum at the Central Library Community Room, 220 State Street, Springfield, from 100 to 3:00 pm.

The Hampden County Legal Clinic has been busy coordinating volunteers for programs in District, Housing and Probate Courts as well as handling foreclosure intake calls.  This would not be possible without the financial support from Massachusetts Mutual. CHILDREN'S LAW PROJECT

The Hampden County Bar Association received an IOLTA Grant from the Massachusetts Bar Foundation in the amount of $59,000 for funding of the Hampden County Bar Association's Children's Law Project for the 2012-2013 Grant year. We are very grateful to the Massachusetts Bar Foundation for their continued support of this program. Through this program, children receive legal representation in the Hampden County Family and Probate Court for an array of matters. Probate and Family Court Chief Justice Paula M. Carey has been named as the Chief Justice for the Trial Court.  Her new position begins July 16, 2013.

Belchertown District Court Bench Bar Meeting

The Bench Bar Committee Meeting for Belchertown District Court has been scheduled for June 11, 1013 at 1pm in the jury pool room. All are welcome to discuss any concerns, comments, suggestions they may have with the policies and procedures of the court. Anyone who cannot attend but has a concern or question can email me at jpm@mckennapc.com and I will ask your question.    Judge John Payne, Presiding Justice, Robert Ryan, Chief Probation Officer, William Nagle, Clerk Magistrate, Robert Opsitnik, Attorney in Charge, District Attorney’s Office are expected to attend.

Pro Bono-Domestic Relations Judicial Seminar

The Massachusetts Justice Project will be holding their annual Pro Bono-Domestic Relations Judicial Seminar  in conjunction with the Hampden, Hampshire, Franklin & Berkshire county bar associations.  This year's event will be held at the Summit View Restaurant, 555 Northampton Street (Route 5), Holyoke, on Wednesday, June 12, 2013, in the afternoon.  The Western Massachusetts Probate and Family Court justices will be speaking. 4th Annual C.O.R.I. Independence Day

Arise for Social Justice is co-sponsoring the 4th Annual C.O.R.I. Independence Day event on June 28, 2013.  The event will be held at Blunt Park, 2460 Roosevelt Avenue, Springfield, MA from 11:00 am until 4:00 pm.  The organizers have reached out to the Hampden County Bar Association seeking volunteer attorneys to explain the recent changes in the C.O.R.I. law, effective May 4, 2012, assist with the filing of the petitions to seal CORI records, requesting CORI records and help with filling out the Affidavit of Indigence for those you qualify.  Notary Publics will be needed.
