On April 25, 2014, I had the pleasure and good fortune of participating in the “Practicing with Professionalism” Program held at Western New England University Law School.  The program was put on by the Hampden County Bar Association, in conjunction and partnership with Boston Bar Association, in accordance with the recently adopted Rule 3:16 of the Supreme Judicial Court, which now requires that all newly licensed practitioners in the Commonwealth, must complete a one-day “Practicing with Professionalism” Course effective September 1, 2014.   The rule requires that in order for lawyers to maintain their admission in good standing to the Bar, they must complete the course within eighteen (18) months of their date of admission.  We were fortunate enough to partner with the Boston Bar Association as well as seven (7) other bar associations: the Asian-American Lawyers Association of Massachusetts, the Massachusetts Association of Hispanic Attorneys, the Massachusetts Black Lawyers Association, the Massachusetts Black Women Attorneys, the Massachusetts LGBTQ Bar Association, the South Asian Bar Association of Greater Boston, and the Women’s Bar Association of Massachusetts.

Participating in the program was personally rewarding and beneficial and looking back, I wish I had the opportunity to attend such a program when I became a member of the Massachusetts Bar.   I was fortunate enough to land a job with a great law firm which had and has some incredible mentors to provide guidance and professional insight.  I still work with some of those individuals today and would be remiss if I did not acknowledge one of the former founding partners, former Superior Court Judge, Frederick Pillsbury.   He was an incredible talent who had a wealth of knowledge about the law and was one of the most respected litigators and jurists of his day and a tremendous mentor.

With the change in the legal landscape, today there are more and more solo practitioners, especially in the Western Massachusetts community, who do not have the benefit of joining an established firm where doors are open for ready consultation at any moment.  Fortunately, there are saving graces for many newly admitted attorneys, through the Bar Association affiliations, such as the HCBA, where continuing legal education programs, social functions, and community involvement serve as a means of guidance and mentoring.  Being affiliated with a bar association no matter where one practices, provides an invaluable resource and means of interacting and networking with attorneys who do not necessarily practice in the same areas of law.

The Professionalism Program provided an opportunity for panel members to share their professional experience, mostly positive, and to lend advice and guidance so as to avoid pitfalls that can frequently plague new practitioners.  I am proud to say that the panel members consisted primarily of practitioners affiliated with the Hampden County Bar Association who served on panels dealing with issues of professionalism, ethical standards, Board of Bar Overseer issues, law office management, social media, and related topics.  I especially want to thank Retired Supreme Judicial Court Justice John Greaney for his willingness to participate in the program, and the insight he provided, as well as Attorneys Elizabeth Dineen, Christina Turgeon, Charles Casartello, John McCarthy, Tom Kenefick, Kevin Maltby, Kelly Koch, Kyle Guelcher and Dennis Herchel.   I also want to acknowledge and thank Noreen Nardi and her staff for helping to coordinate the program and making it a success.

This was our first real interaction with the Boston Bar Association and other bar association affiliations in terms of a collaborative effort to coordinate an educational program of this magnitude.  We are hopeful that we will continue to work with the Boston Bar Association and the other associations so that we can continue to offer this “Practicing with Professionalism” Program and other educational programs for years to come.  I would also welcome local practitioners to join in as panel members in future presentations to share and give back some of their knowledge and expertise to newly admitted practitioners in order to assist them in getting started in their practices.  As D.H. Lawrence once said: “Ethics and equity and the principles of justice do not change with the calendar.”

On a separate note, I would like to welcome all members of the Hampden County Bar Association and others, to participate in this year’s annual golf outing on May 22, 2014, at the Ranch Golf Course in Southwick.  Even if you are not a golfer, please join us for dinner, as this is one of our largest social gatherings of the year. I would also request that when, if at all possible, you please try to patronize our various sponsors and vendors who help support our Bar Association and who serve as sponsors at our several annual events.  Without their assistance and support, we would not be able to function in the manner in which we have been become accustomed.

Finally, this past week I attended three separate funerals for members of the HCBA legal community over the course of six days.  We lost three remarkable individuals with the passing of Jason Thompson, Bert Scannapieco and former HCBA President, Richard Egan.  I would like to especially thank the members of the HCBA who served as part of the honor guard at those services.   This is a tradition that we adopted several years ago that I am proud and privileged to be a part of as a member of the HCBA.

The Hampden County Bar Association would like to welcome the following attorneys and students as new members:

Laura A. Fisher – Western New England University School of Law

The Hampden County Bar Association Arbitration & Mediation Service maintains a roster of highly qualified lawyers and retired judges for arbitration, mediation, or case evaluations. Our panel members, as an accommodation to the Bar Association, have agreed to serve at substantially reduced rates for arbitrations, mediations or case evaluations. Indeed, many of our panel members independently mediate and arbitrate cases at higher rates. Why not conserve resources by coordinating your arbitrations or mediations through the Hampden County Bar Association? We encourage you to support your bar association by keeping the Arbitration and Mediation Service in mind for alternative dispute resolution. For a complete list of arbitrators/mediators and the type of cases they handle, please click here.

A Note from Justice Campaign Co-Chair Barry M. Ryan

Over the next few weeks, we will be reaching out to as many of you as possible in person to ask for your financial support of legal aid here in Hampden County.  Your financial contributions are essential to providing free legal assistance to those in need in the communities where we live and work.  Your support transforms lives by: Defending victims of abuse, Preventing homelessness, Ensuring health and safety, Protecting jobs and economic security and Fighting discrimination.

The need for legal services far outstrips our ability to provide them.  Community Legal Aid is forced to turn away over half of the eligible people who ask for help. Each of these people is in a legal crisis.  But every time limited funds  impede  CLA’s ability to accept a case, they have to make agonizing decisions:  Which battered woman is in the MOST immediate danger without legal help?  Which family will become homeless FIRST without legal representation?

If you are a supporter of Community Legal Aid already, we thank you and encourage you to continue your generosity when you are called.  If you have not yet donated, we encourage you to respond when contacted.

On behalf of the Community Legal Aid family, thank you for being one of our greatest friends and allies as we work together to provide fairness and justice for all the residents of central and western Massachusetts.
