MESSAGE FROM PRESIDENT BARRY M. RYAN

As I wind down my final days, it has truly been an honor and privilege to have served as the President of the Hampden County Bar Association.  I look back on the year and my several years serving on the Board with fond memories and a sense of accomplishment.  Serving on the Board and, most recently, as President, has afforded me an opportunity to make new friendships and to cement some old ones.

For 150 years our association has been dedicated and committed to enhancing the lives and practices of our members, promoting access to justice, serving our community and enriching the relationship between the bench and the bar, on both state and federal levels. At the time of our Annual Dinner, we had 1,025 members and our goal is to continue to expand our membership and to offer relevant and quality continuing legal education programs. We will also continue to include active participation from the local judiciary in our various educational programs and Bench Bar Committees.  For those members who have not taken an active role in the association, I strongly encourage you to consider being more active, even on a voluntary capacity as a member of one of our committees, or by participating in one of our educational programs, as a presenter or co-presenter.  Our continuing education programs have been diverse and have touched on broad topic areas that involve both attorneys and expert practitioners in their respective fields, who are highly regarded and recognized by their peers.

I would like to acknowledge the members of our various committees who have assisted in making this year a success.  Our Educational Committee and programs are as good as, if not better, than any offered in the state by any other bar organization or professional entity.  I was proud to be a part of a joint effort with the Boston Bar Association earlier this year to present a “Practicing with Professionalism” program at WNEU law school, which by all accounts was a great success, and look forward to similar collaborative efforts in the future. 

We have a strong and vibrant organization that I know will continue to grow and serve the needs of its members and the surrounding community in the years ahead.  I think we are unique, as was evidenced by the comment of the President-Elect of the MBA, Robert Harnais, who attended our Annual Dinner and presented former Bar President and Board of Director member, Archer Battista, with the MBA Community Service Award.  In his remarks, Attorney Harnais noted that the HCBA was a congenial, family-type, close knit organization.  It is nice to hear such positive comments from a Boston practitioner who has limited interaction with Hampden County. 

Over the past year and in the year ahead several changes have and/or will occur, including new faces on the bench in several of our courts in Hampden County, a new District Attorney, succeeding the Honorable Mark Mastroianni and interim DA, Jim Orenstein, as well as some procedural changes, inclusive of the allowance of attorney voir dire in Superior Court trials.  Some change is inevitable and for the common good.   

As I close out my term, I can’t help but remember the Honorable Edward Peck’s remarks after he received the Honorable William T. Walsh Award.  I would encourage you to heed his advice and “seize” the moment before it passes you by.  Many years ago, my good friend and partner, Dave Martel, approached me and asked me to consider running for the Board of Directors. I am truly happy and fortunate to have taken Dave’s advice and to have continued serving as a member of the Board for the past 7 years.  Although there is a definite time commitment in serving on the Board, it has been an experience that I truly treasure and will continue to treasure as I serve in an Ex-officio capacity for hopefully several years to come. 

I also have to thank and recognize those Board members with whom I have served over the years and, particularly, Executive Director, Noreen Nardi, and her dedicated staff.  I would also like to thank (and I ask you, once again, to please consider patronizing and supporting) our various supporters and vendors who have contributed and supported our association over the years.

Later this year, we will be celebrating a milestone, our 150 Anniversary. I expect this to be a memorable event that I know I will not miss out on, God willing.  Unfortunately, we will not be able to share this evening with many of our deceased members and colleagues who have come before us, including those we lost this past year, inclusive of 3 members of the judiciary, The Honorable Robert Kumor, Milton Raphaelson, and Sidney Cooley.   

In closing, I am happy to assume the role of immediate Past President and to continue working with my colleagues and the Board and, in particular, with my successor, Christina Turgeon, whom I know will be a great leader and advocate for the bar. Once again, I thank you for the privilege as serving as your president.  It has been an experience and adventure that I will treasure and remember forever.  As I close out my final President’s Message, I leave you with the words of former first lady, Eleanor Roosevelt: “In the long run, we shape our lives, and we shape ourselves. The process never ends until we die. And the choices we make are ultimately our own responsibility.”

The Hampden County Bar Association will host a 150th Anniversary Gala on Friday, November 7, 2014 at The Log Cabin, 500 Easthampton Rd, Holyoke, MA.  The event will be black-tie optional and entertainment will be by Brass Attack of Springfield.  For those of you who remember the Barrister Ball, this will be similar to that event.

PRACTICE DEVELOPMENT SERIES

The Practice Development Series discusses "Real Life Lawyering". The series objective is to support lawyers, particularly new practitioners, solo practitioners and members of small firms, to improve professional skills, increase collegiality and decrease the business, liability ethical and health risks of practice. Volunteer Opportunities in Probate Court

There is an critical need for volunteers in Probate Court during the month of August.   We all have more than enough demands on our time already, but the volunteer programs we have in place in Hampden County are invaluable to the Probate Court and to the public it serves.  Please carve out a few hours one day this month to help out.

The Probate Court Bench Bar Sub-Committee on Volunteer Opportunities in conjunction with the Hampden County Bar Association offer various volunteer programs, along with a calendar of available dates that volunteers are needed in the Probate & Family Court.  The programs include Conciliation, Pre-Trial Limited Assistance Representation, DOR Contempts and Lawyer for the Day.

The Lawyer for the Day program continues to be a success due to the many volunteers who have offered their services in Western Division Housing Court on Thursdays. This is a great pro bono opportunity for area attorneys. This program benefits landlords and tenants who are income eligible. HCBA ARBITRATION/MEDIATION SERVICE

The Arbitration & Mediation Service is proud to announce new additions to our panel:  Attorney John G. Bagley, Attorney Kevin C. Giordano, Attorney Nathan A. Olin, and Attorney Jennifer A. Thorn, impressive additions to our roster.

The Hampden County Bar Association Arbitration & Mediation Service maintains a roster of highly qualified lawyers and retired judges for arbitration, mediation, or case evaluations. Our panel members, as an accommodation to the Bar Association, have agreed to serve at substantially reduced rates for arbitrations, mediations or case evaluations. Indeed, many of our panel members independently mediate and arbitrate cases at higher rates. Why not conserve resources by coordinating your arbitrations or mediations through the Hampden County Bar Association? We encourage you to support your bar association by keeping the Arbitration and Mediation Service in mind for alternative dispute resolution. LAWYER REFERRAL & INFORMATION SERVICE

The Hampden County Bar Association's Lawyer Referral & Information Service (LRIS) meets American Bar Association standards for lawyer referral and has a Reduced Rate Panel. Anyone interested in participating in the lawyer referral program can contact our office at 413-732-4660 or via email at lawyerreferral@hcbar.org.  Within the last month, attorneys have submitted over $9,698.25 in LRIS referral percentage payments a result of over $64,655.00 in client fees.

If you receive a call from a potential client looking for assistance in an area of law that you do not practice, why not refer them to the Hampden County Bar Association's Lawyer Referral & Information Service? All members of the LRIS are your experienced colleagues. Support your LRIS in providing quality referrals in our community!

Currently the LRIS is in need of attorneys on our Panel that handle ERISA cases.


HAMPDEN COUNTY LEGAL CLINIC

The Hampden County Bar Association would like to continue to acknowledge the funding received by Mass Mutual Financial Group in the amount of $20,000 for the Legal Clinic for 2014. We are very grateful to the Mass Mutual Financial Group for their continued support of this program. The Hampden County Legal Clinic has been busy coordinating volunteers for programs in District, Housing and Probate Courts as well as handling housing, consumer protection, and foreclosure intake calls.  This would not be possible without the financial support from Mass Mutual Financial Group. CHILDREN'S LAW PROJECT

The Hampden County Bar Association received an IOLTA Grant from the Massachusetts Bar Foundation in the amount of $45,000 for funding of the Hampden County Bar Association's Children's Law Project for the 2014-2015 Grant year. We are very grateful to the Massachusetts Bar Foundation for their continued support of this program. Through this program, children receive legal representation in the Hampden County Family and Probate Court for an array of matters. In an effort to continue the important work of this program, the Hampden County Bar Association Board will allocate the proceeds from the 1st Annual Race Judicata to the Children's Law Project.  Thank you  for your support.

Training

The Children's Law Project will hold an educational training on Tuesday, August 26, 2014 between 1:00 pm and 3:00 pm at Egan, Flanagan & Cohen, P.C., 67 Market Place, Springfield.

This seminar is FREE and open to all Children's Law Project attorneys as well as other interested attorneys.  The training will focus on dealing with high conflict litigants in CLP cases and will also include a roundtable discussion with Department of Child & Family Services.

Hospice Volunteer Opportunity

Have you ever considered volunteering for hospice?  Volunteer opportunities could include anything from a drive to the grocery store, doctor visits, or drafting estate documents.   A special condensed, three-hour hospice volunteer training program is now being offered by Baystate VNA & Hospice for members of the Hampden County Bar Association.  Enrolled attorneys will undergo a course in pain management and bereavement, as well as several other important areas of hospice care.  Providing hospice care to Massachusetts residents is an honorable, and important cause that we hope more members of the Hampden County Bar Association will embrace.  The dates of this program are to be announced.  Attorney Stephen J.
