I want to start by saying that Sen. Elizabeth Warren and Congressmen Richard Neal deserve a lot of credit for working hard to get us what we need with respect to filling the judicial vacancy here in Springfield. A few months ago, our own Nate Olin spearheaded a campaign by the local chapter of the Federal Bar Association, Western Mass. Bar Association Presidents and other leaders to meet, discuss and, then, co-author a request of Sen. Elizabeth Warren, Congressman Neal and others to move swiftly to push forward the nomination for the position in the U.S. District Court in Springfield. It was very well received and we had high hopes. I had repeatedly expressed my belief (and that of countless members of our association with whom I have spoken) to Sen. Warren’s office, Congressman Neal’s office (and frankly anyone who would listen) that there is no one better suited to attempt to fill the enormous shoes of Judge Michael Ponsor than the prior applicant Judge Jeffrey Kinder, who has distinguished himself on and off the Superior Court bench in so many ways. I was again very pleased that Sen. Warren’s office called our association for direct input on making appointments to a new panel. However, in mid-March, we simultaneously learned that Judge Kinder was regrettably withdrawing his application, and Sen. Warren had appointed a distinguished panel of Western Massachusetts’ attorneys consisting of Mike Jennings, Tom Lesser, Jennifer Levi, John Pucci, and Katherine Robertson to review new applications for the Springfield vacancy. Although very pleased that the panel is comprised of a number of our members, I could not help but be reminded of the Rolling Stones’ lyrics:
You can't always get what you want
The bottom line is that we need to have the vacancy filled as soon as possible by an exceptional candidate from Western Massachusetts, and the April 15th deadline for new applicants is almost here. We know that Richie Neal was always committed to doing everything he can to get this done. Now after seeing her quick response, the solid panel that she has assembled and after a lengthy meeting with her State Director and local surrogate last week, I really trust that Sen. Warren is as deeply committed to getting us what we need, which is a unique and exceptional person with deep roots in our community sitting in Springfield who is as warm, eloquent, innovative and active on the bench as they will be off of it. As such, we have circulated the application and hope that as many of the former applicants and new applicants apply to fill this extremely important vacancy.

The ballot for President-Elect and Board of Directors for the upcoming year will soon be sent to all members of the Hampden County Bar Association. Pursuant to the by-laws of the HCBA, a member interested in running for President-Elect and/or the Board of Directors can request that the ballot indicate his or her willingness to serve. A member may run for both the President-Elect position and the Board of Directors at the same time.
Members who would like to be designated on the ballot as having an interest in serving on the Board of Directors, including any incumbent Board of Directors members wishing to serve another term, please notify us by May 1, 2013. The names of members submitting their names and any other members chosen by the Nominating Committee will appear on the election ballot.
1. Promote the mission & goals of the Hampden County Bar Association;
Applications for the John F. Moriarty Scholarship are now available to any Hampden County resident who has been admitted to or is attending a certified law school for the 2013-2014 academic year. Applicants must have been residents of Hampden County for at least five years. The scholarship is based on merit and financial need. Applications are available at the HCBA office, 50 State Street, Springfield, MA 01103, by calling 732-4648, or by emailing admin @hcba.org. Please include the applicant's mailing addess with any requests. All applications must be completed and filed with the HCBA by May 24, 2013.

Superior Court View from the Bench
The Practice Development Series discusses "Real Life Lawyering". The series objective is to support lawyers, particularly new practitioners, solo practitioners and members of small firms, to improve professional skills, increase collegiality and decrease the business, liability ethical and health risks of practice. The Hampden County Bar Association and the local courts will be hosting the 2013 Law Day, "Realizing the Dream: Equality for All" on Wednesday, May 1, 2013 at 10:00 am, in Springfield District Court. There will be a mock trial presentation by students from PVPA. Judge Michael Ponsor, along with various District Court judges will be participating in this event.
HCBA Day at the Melha Shrine Circus
Come join the HCBA for an afternoon of fun at the Shriner's Circus! Once again this year, the Hampden County Bar Association is sponsoring the circus, and has been invited to the performance on Saturday, May 4, 2013 at 2:30 pm at a reduced rate. There will be a limited number of tickets available for HCBA members and their families for this performance. The Probate Court Bench Bar Sub-Committee on Volunteer Opportunities has developed a calendar that gives a brief description of the various volunteer programs, along with the dates that volunteers are needed in the Probate & Family Court. The programs include Conciliation and LAR/Lawyer for the Day opportunities.
The Trial Court Chief Justice, Robert A. Mulligan, has approved a modification to the training requirement guidelines for Court-Connected Conciliators in Probate Court. Attorneys who have completed an approved mediation training program will now be permitted to serve as conciliators in a court-approved program. Anyone who has mediation training and is interested in learning more about the Conciliation Program in the Hampden County Probate & Family Court are asked to contact Gina M. Pre-Trial Conference Program
The Probate Pre-Trial Conference Program is a great pro bono opportunity for attorneys to offer their services in the Probate Court. Sessions are held every other Tuesday with an occasional Thursday. Bench Bar Notes of March 18, 2013:
ADA Jane Montori, Chief Appellate ADA gave an update on the proposed changes to Rule 12. Terry Nagle spoke about the drug lab issued resulting from the actions of Anne Dookhan and more recently, Sonja Farak and how they are affecting Hampden County, with more technical issues arising from post-trial or post plea cases.
About 20-25 people attended, along with Judge William Hadley and Judge Robert Gordon.

Lawyer for the Day-District Court
The Lawyer for the Day program continues to be a success due to the many volunteers who have offered their services in District Court on Wednesdays and Thursdays. This is a great pro bono opportunity for area attorneys. This program benefits landlords and tenants who are income eligible. We’d like to thank the following individuals who volunteered for Wednesdays and Thursdays in March: Attorney Eric C. The next Juvenile Court Bench Bar meeting will be held on Wednesday, May 1, 2013 at 1:00 p.m. The Bench Bar meetings are held the first Wednesday of the month and are open to all attorneys who practice in Juvenile Court.

The Hampden County Bar Association Arbitration & Mediation Service is pleased to announce that our service has been approved as a qualified ADR Program for the Hampden County Superior Court, approved by Superior Court Chief Justice Barbara J. Rouse, as well as a qualified ADR provider for the Western Division Housing Court Department, approved by Housing Court Chief Justice Steven D. Pierce. As a provider of court connected dispute resolution services, the Hampden County Bar Association Arbitration & Mediation Service will be listed on the Superior and Housing Courts' list of approved programs from January 1, 2013 through December 31, 2015.
The Hampden County Bar Association Arbitration & Mediation Service maintains a roster of highly qualified lawyers and retired judges for arbitration, mediation, or case evaluations. Our panel members, as an accommodation to the Bar Association, have agreed to serve at substantially reduced rates for arbitrations, mediations or case evaluations. Indeed, many of our panel members independently mediate and arbitrate cases at higher rates. Why not conserve resources by coordinating your arbitrations or mediations through the Hampden County Bar Association? We encourage you to support your bar association by keeping the Arbitration and Mediation Service in mind for alternative dispute resolution. The Hampden County Bar Association's Lawyer Referral & Information Service (LRIS) meets American Bar Association standards for lawyer referral and has a Reduced Rate Panel. Within the last month, attorneys have submitted over $2,611.02 in LRIS referral percentage payments a result of over $17,500.00 in client fees.

On April 25, 2013, the Hampden County Bar Association Lawyer Referral & Information Service and Hampden County Legal Clinic, in conjunction with Springfield City Library, will hold a public Question & Answer forum at the Brightwood Branch Library, 359 Plainfield Street, Springfield, from 6:00 to 8:00 pm.
The Hampden County Legal Clinic has been busy coordinating volunteers for programs in District, Housing and Probate Courts as well as handling foreclosure intake calls. This would not be possible without the financial support from Massachusetts Mutual. The Hampden County Bar Association received an IOLTA Grant from the Massachusetts Bar Foundation in the amount of $59,000 for funding of the Hampden County Bar Association's Children's Law Project for the 2012-2013 Grant year. We are very grateful to the Massachusetts Bar Foundation for their continued support of this program. Through this program, children receive legal representation in the Hampden County Family and Probate Court for an array of matters. Supreme Judicial Court Pro Bono Honor Roll
The Supreme Judicial Court wishes to recognize law firms, solo practitioners, in-house corporate counsel, government attorneys' offices, non-profit organizations and law schools for their commitment to pro bono legal work through the Pro Bono Honor Roll. Participation is voluntary.
The organizations which certify that they have met specific criteria will receive a letter of acknowledgement and appreciation for their pro bono work, will be listed on the Pro Bono Honor Roll on the SJC website and, if certification is submitted by September 27, 2013, will be invited to send a representative to the October 2013 recognition event at the John Adams Courthouse.
