MESSAGE FROM PRESIDENT JOSEPH M. PACELLA

Please remember to sign up for the annual HCBA golf tournament and/or dinner on May 16th at the Ranch Golf Club in Southwick.  Space is very limited, so act fast!  This is a great member benefit that is subsidized by our many sponsors.  You could not play a round at the Ranch for what we are charging, let alone get a few gifts, lunch and dinner.  We are always looking for additional sponsors and raffle prizes, so please take a moment to solicit a sponsor or gift and let us know if you can help. 

It is election time again.  President Theodore Roosevelt once said that, “A vote is like a rifle: its usefulness depends upon the character of the user.”  With this call to arms in mind, I would like to ask you to seriously consider every candidate on the slate and to cast your ballot for our next Board of Directors.  You will be receiving the ballots soon, and there are a lot of new and well qualified candidates to choose from.  When I was sworn in last year, you may recall that I unsuccessfully ran for the Board a ridiculous number of years before actually being elected, so I applaud all of these candidates for putting themselves out there and agreeing to make this serious commitment.  Whether elected or not, we truly hope to gain their continued short and long-term involvement.  This is a real testament to the hard work that Noreen and all of the members of the Board of Directors have been doing for several years now in fastidiously trying to provide additional and improved programming as well as volunteer and social opportunities in order to increase the diversity of our membership across all sect of the bar as well as to encourage former New Lawyers Section members to continue to stay involved. 

In this regard, you will receive a proposed amendment to our by-laws which will place former Presidents into ex-officio status for a significantly longer period of time, thus removing several of them from the ballot prior to this election.  We hope that this will increase the size and thus productivity of the Board two fold.  First, it will continue to provide a wealth of knowledge and continuity in leadership for the Board by increasingly the voluntary participation of additional past Presidents.  Secondly, and even more importantly, it will open up seats for many more of these new candidates to participate at the Board level, adding fresh ideas and more hands on deck to deal with ever increasing programming that the HCBA provides. 

It is a very exciting time for our Association and I want to thank all of you in advance for your time and attention to this very important matter.

HCBA ELECTIONS

The ballot for President-Elect and Board of Directors for the upcoming year will be mailed shortly to all eligible voting members of the Hampden County Bar Association. The office of the Hampden County Bar Association must receive this Ballot in the enclosed envelope no later than 4:00 p.m. Monday, June 10, 2013. Pursuant to HCBA bylaws, ballots received later than that date and time will not be counted.


JOHN F. MORIARTY SCHOLARSHIP

Applications for the John F. Moriarty Scholarship are now available to any Hampden County resident who has been admitted to or is attending a certified law school for the 2013-2014 academic year.  Applicants must have been residents of Hampden County for at least five years.  The scholarship is based on merit and financial need.  Applications are available at the HCBA office, 50 State Street, Springfield, MA 01103, by calling 732-4648, or by emailing admin@hcba.org.  Please include the applicant's mailing address with any requests.  All applications must be completed and filed with the HCBA by May 24, 2013.

The Hampden County Bar Association hosted Law Day on May 1, 2013 in Springfield District Court.  We would like to thank the Honorable Michael Ponsor our featured speaker, along with Mr. Gary Huggett and the Mock Trial Team from Pioneer Valley Performing Arts School. The students from PVPA presented a Mock Trial Oral Argument on DOMA.  Each year, when Law Day is observed, two individuals, one attorney and one non-attorney is presented with the John M. Greaney Award recognizing them for their contributions to the Hampden County law community and their efforts to improve the practice of law, the administration of justice and service to the public and the law community. This year’s recipients were Attorney Richard C. Morrissey and Mr. Raymond F. Catuogno. Congratulations to you both!  Thank you to Judge Greaney for presenting these awards.

BANKRUPTCY SECTION

Volunteer Opportunities

The Probate Court Bench Bar Sub-Committee on Volunteer Opportunities has developed a calendar that gives a brief description of the various volunteer programs, along with the dates that volunteers are needed in the Probate & Family Court. The programs include Conciliation and LAR/Lawyer for the Day opportunities.

Conciliation Guidelines
 

The Trial Court Chief Justice, Robert A. Mulligan, has approved a modification to the training requirement guidelines for Court-Connected Conciliators in Probate Court.  Attorneys who have completed an approved mediation training program will now be permitted to serve as conciliators in a court-approved program. Anyone who has mediation training and is interested in learning more about the Conciliation Program in the Hampden County Probate & Family Court are asked to contact Gina M. Barry, Esq., Bacon Wilson, P.C. via email at gbarry@baconwilson.com.

Pre-Trial Conference Program

HCBA ARBITRATION/MEDIATION SERVICE

The Hampden County Bar Association Arbitration & Mediation Service maintains a roster of highly qualified lawyers and retired judges for arbitration, mediation, or case evaluations. Our panel members, as an accommodation to the Bar Association, have agreed to serve at substantially reduced rates for arbitrations, mediations or case evaluations. Indeed, many of our panel members independently mediate and arbitrate cases at higher rates. Why not conserve resources by coordinating your arbitrations or mediations through the Hampden County Bar Association? We encourage you to support your bar association by keeping the Arbitration and Mediation Service in mind for alternative dispute resolution. LAWYER REFERRAL & INFORMATION SERVICE

The Hampden County Bar Association's Lawyer Referral & Information Service (LRIS) meets American Bar Association standards for lawyer referral and has a Reduced Rate Panel. Anyone interested in participating in the lawyer referral program can contact our office at 413-732-4648 or via email at lawyerreferral@hcbar.org. Within the last month, attorneys have submitted over $2,208.00 in LRIS referral percentage payments a result of over $13,400.00 in client fees.

If you receive a call from a potential client looking for assistance in an area of law that you do not practice, why not refer them to the Hampden County Bar Association's Lawyer Referral & Information Service? All members of the LRIS are your experienced colleagues. Support your LRIS in providing quality referrals in our community!

Dial-A-Lawyer

On Monday, April 29, 2013, the Hampden County Bar Association sponsored Dial - A - Lawyer with WHYN Channel 40 television in conjunction with their 5:00 pm news   Attorney David K. Bartley states that it was a great experience.  Each of the 7 or 8 attorneys answered several phone calls and were able to provide adequate advise to the callers.  We look forward to hosting this event with more local television stations in the future.

Ask-A-Lawyer

On Thursday, April 25, 2013, the Lawyer Referral & Information Service and Hampden County Legal Clinic, in conjunction with Springfield City Library, held a public Question & Answer forum at the Brightwood Branch Library, 359 Plainfield Street, Springfield, from 6:00 to 8:00 pm.   Attorney Robert C. Sacco and Attorney Gordon Shaw volunteered for this Ask-A-Lawyer: Free Legal Advise forum, answering the community's legal questions.  This event was a success noted  Mr. Matthew Jaquith, Adult Program & Training Librarian, based on the encouraging evaluation forms and the attendees' satisfaction in having their legal questions answered.

HAMPDEN COUNTY LEGAL CLINIC

On Saturday, October 19, 2013, the Lawyer Referral & Information Service and Hampden County Legal Clinic, in conjunction with Springfield City Library, will hold a public Question & Answer forum at the Central Library Community Room, 220 State Street, Springfield, from 100 to 3:00 pm.

The Hampden County Legal Clinic has been busy coordinating volunteers for programs in District, Housing and Probate Courts as well as handling foreclosure intake calls.  This would not be possible without the financial support from Massachusetts Mutual. CHILDREN'S LAW PROJECT

The Hampden County Bar Association received an IOLTA Grant from the Massachusetts Bar Foundation in the amount of $59,000 for funding of the Hampden County Bar Association's Children's Law Project for the 2012-2013 Grant year. We are very grateful to the Massachusetts Bar Foundation for their continued support of this program. Through this program, children receive legal representation in the Hampden County Family and Probate Court for an array of matters. Pro Bono-Domestic Relations Judicial Seminar-SAVE THE DATE! 

The Massachusetts Justice Project will be holding their annual Pro Bono-Domestic Relations Judicial Seminar  in conjunction with the Hampden, Hampshire, Franklin & Berkshire county bar associations.  This year's event will be held at the Summit View Restaurant, 555 Northampton Street (Route 5), Holyoke, on Wednesday, June 12, 2013, in the afternoon.  The Western Massachusetts Probate and Family Court justices will be speaking. Please save the date and watch for details. 

Senior Partner's for Justice Lunch

The Senior Partners for Justice luncheon will be held on Wednesday, May 15, 2013 from 1:00 p.m. - 2:00 p.m. at Sovereign Bank Community Room, 3rd Floor, 1350 Main Street, Springfield, MA.  

The guest speaker will be The Honorable Judith A. Cowin (Ret.), a recently retired Associate Justice of the Massachusetts Supreme Judicial Court, who will will share her insights about key family and probate law cases decided by the SJC in recent years.
