MESSAGE FROM PRESIDENT BARRY M. RYAN

The HCBA is greatly appreciative of the financial assistance and support provided by the MassMutual Financial Group.  Without their financial assistance and continued support, our Legal Clinic would not be nearly as effective as it is today.  Recently, MassMutual issued a $20,000 grant to the HCBA Legal Clinic, with additional volunteer support through the company’s in-house legal team.  Mark Roellig, Executive Vice President and General Counsel at MassMutual, expressed the commitment to making the communities where we live a better place by donating financial support and legal assistance.  With this grant and the actions of its lawyers, MassMutual continues to demonstrate its excellence as a corporate citizen.

The Hampden County Legal Clinic provides legal aid and assistance to numerous individuals in need. These individuals require assistance in landlord-tenant and consumer-related matters. The Legal Clinic coordinates with Western New England University School of Law and MassMutual to provide these individuals with much-needed legal services.  Only income eligible individuals are approved for representation.  The HCBA screens potential clients to ensure they meet specific financial eligibility requirements.

MassMutual also provides assistance, along with the Women’s Bar Foundation and the Massachusetts Justice Project, to assist our Legal Clinic with the Lawyer for the Day Programs for the Western Division Housing Court, the Springfield District Court, and the Hampden County Probate Court. 

Through the aforementioned programs, the Legal Clinic promotes access to justice for people of low or no income, helps relieve our courts and administrators from the high volume of pro se litigants and improves and promotes the public image of lawyers through this pro bono service.  Without this generous sponsorship, we would not be able to continue the vital work we are doing in our community.

The grant has enabled the Legal Clinic to continue and improve its efforts in expanding much-needed services.  In the 150 years of the HCBA’s existence, which we will celebrate in grand fashion later this year, the Bar Association has strived to live up to its motto and Mission Statement, which is to serve lawyers, the justice system, and the public, as well as one of our core values, which is access to justice. With the assistance of MassMutual, we are continuing to accomplish our goals.  

We hope that our relationship, collaboration and beneficial partnership will continue well into the future so that needy citizens of Hampden County, who meet the necessary qualifications, can be adequately represented in the various courts in our county.

On a closing note, I would like to remind our members that we will be celebrating Judges’ Night on March 27, 2014 at the Delaney House in Holyoke.  Our Keynote Speaker will be the Honorable Timothy Hillman, Justice of the U.S. District Court.  Make sure to mark your calendars!

Hampden County Bar Association Board Member, Matthew Shea, was confirmed as Associate Justice of the Holyoke District Courts by the Governor's Council on Wednesday, February 12, 2014. Congratulations!  We would like to thank Attorney Shea for his years of service on the Hampden County Bar Association Board.  He will be missed!

Andrew Levchuk, Esquire of Bulkley, Richardson and Gelinas, LLP , was recently honored with the U.S. Department of Justice Criminal Division’s Award for Exceptional Service for his work in the corruption prosecution of former U.S. Congressman Richard Renzi. Congratulations!

VETERANS JUSTICE PARTNERSHIP

The Hampden County Bar Association 2nd Annual Texas Hold 'Em Poker Tournament will be held on Thursday, April 10, 2014 from 6:00 pm until 10:00 pm at The Glass Room at Elegant Affairs, 1380 Main Street, Springfield, MA. There will be a $75.00 buy-in.  Proceeds from the tournament will be allocated to the Children's Law Project.

PROBATE & FAMILY COURT

Probate Court Bench Bar Meeting

At the last Probate Court Bench Bar Meeting held on February 27, 2014, The question was raised about the policy of the Registry not to schedule Case Management Conferences unless both parties' PACT certificates are on file.  After follow up discussion between the Register and First Justice, the policy is being changed.  Case Management Conferences now will be scheduled without PACT certificates on file.

Volunteer Opportunities in Probate Court

There is an urgent need for volunteers during the month of March.   We all have more than enough demands on our time already, but the volunteer programs we have in place in Hampden County are invaluable to the Probate Court and to the public it serves.  Please carve out a few hours one day this month to help out.

The Probate Court Bench Bar Sub-Committee on Volunteer Opportunities in conjunction with the Hampden County Bar Association offer various volunteer programs, along with a calendar of available dates that volunteers are needed in the Probate & Family Court.  The programs include Conciliation, Pre-Trial Limited Assistance Representation, DOR Contempts and Lawyer for the Day.

*Mediators Qualified to Serve as Conciliators

Trial Court Chief Justice Robert A. Mulligan has approved a change in the qualification training requirements for Court-Connected Conciliators, as recommended by the Standing Committee on Dispute Resolution. The amended guidelines permit those who have completed an approved mediation training program to serve as a conciliator in a court-approved program subject to the approval of the conciliation program and the completion of the necessary court orientation by the program.  Pursuant to Rule 8(e), in addition to completing the proper training, conciliators must be members of the Massachusetts Bar, be in good standing with the Board of Bar Overseers and must have practiced law in Massachusetts for at least three years.   If you meet these qualifications and would like to sign up to volunteer for the Hampden Conciliation Program, please contact Gina Barry at (413) 781-0560 or at gbarry@baconwilson.com.

The Lawyer for the Day program continues to be a success due to the many volunteers who have offered their services in District Court on Wednesdays and Thursdays. The next Juvenile Court Bench Bar meeting is tentatively scheduled for Wednesday, June 4, 2014 at 1:00 p.m.  The Bench Bar meetings are held quarterly, the first Wednesday of the month and are open to all attorneys who practice in Juvenile Court.

Western Division Housing Court Greenfield Session Temporary Relocation

Western Division Housing Court practitioners should be advised that effective March 7, 2014, the Greenfield session will be moving from its present location in the Juvenile Court to the temporary courthouse located on Munson Street in Greenfield. Once the new courthouse is completed in a few years, Housing Court will move its Franklin County session to the new courthouse.

Lawyer for the Day-Housing Court

The Lawyer for the Day program continues to be a success due to the many volunteers who have offered their services in Western Division Housing Court on Thursdays. This is a great pro bono opportunity for area attorneys. This program benefits landlords and tenants who are income eligible. The Hampden County Bar Association Arbitration & Mediation Service maintains a roster of highly qualified lawyers and retired judges for arbitration, mediation, or case evaluations. Our panel members, as an accommodation to the Bar Association, have agreed to serve at substantially reduced rates for arbitrations, mediations or case evaluations. Indeed, many of our panel members independently mediate and arbitrate cases at higher rates. Why not conserve resources by coordinating your arbitrations or mediations through the Hampden County Bar Association? We encourage you to support your bar association by keeping the Arbitration and Mediation Service in mind for alternative dispute resolution. LAWYER REFERRAL & INFORMATION SERVICE

The 2014 panel registration forms for participation on the Hampden County Bar Association Lawyer Referral & Information Service are now due.  Anyone who has not renewed their registration will be removed from rotation on March 7, 2014. If you did not receive a renewal application or for more information about the LRIS program, contact 413-732-4660 or visit our website at www.hcbar.org.

The Hampden County Bar Association's Lawyer Referral & Information Service (LRIS) meets American Bar Association standards for lawyer referral and has a Reduced Rate Panel. Anyone interested in participating in the lawyer referral program can contact our office at 413-732-4660 or via email at lawyerreferral@hcbar.org.

Within the last month, attorneys have submitted over $1,415.00 in LRIS referral percentage payments a result of over $9,427.00 in client fees.

If you receive a call from a potential client looking for assistance in an area of law that you do not practice, why not refer them to the Hampden County Bar Association's Lawyer Referral & Information Service? All members of the LRIS are your experienced colleagues. Support your LRIS in providing quality referrals in our community!

HAMPDEN COUNTY LEGAL CLINIC

The Hampden County Bar Association is pleased to announce we received funding from Mass Mutual Financial Group in the amount of $20,000.00 to fund the Legal Clinic for 2014.  We are very excited to continue our partnership with Mass Mutual Financial Group. The Hampden County Legal Clinic has been busy coordinating volunteers for programs in District, Housing and Probate Courts as well as handling housing, consumer protection, and foreclosure intake calls.  This would not be possible without the financial support from Mass Mutual Financial Group. CHILDREN'S LAW PROJECT

The Hampden County Bar Association received an IOLTA Grant from the Massachusetts Bar Foundation in the amount of $50,000 for funding of the Hampden County Bar Association's Children's Law Project for the 2013-2014 Grant year. We are very grateful to the Massachusetts Bar Foundation for their continued support of this program. Through this program, children receive legal representation in the Hampden County Family and Probate Court for an array of matters. In an effort to continue the important work of this program, the Hampden County Bar Association Board has allocated the proceeds from the Golf Outing and Poker Tournament to go to the Children's Law Project.  Please support these events and help this important cause.

Hampden County District Attorney Debate

On Thursday, April 10, 2014 from 6:00pm to 7:30pm at Morgan School, the South Holyoke Safe Neighborhood Initiative will hold a debate between the candidates for the upcoming District Attorney race.  The word is, that all the candidates have committed to attend the debate.  There will also be a Latino Forum on Crime that will be hosting the debate.  If you have any questions or need additional information, please contact Anthony Soto at (413) 330-9722.  There will be an event flyer to follow and all are encouraged to attend.

Court Closures

In an effort to provide timely information to our members when a local court is closed due to inclement weather, the Hampden County Bar Association has recently joined an email notification list through the Trial Court.  If you too would like to receive email notifications of court closings from the Trial Court, you can send an email to closuresrequest@jud.state.ma.us from the email account where you want to receive the notices.  You will then be sent an email with further instructions to complete the process for being added to the notification list.  In the alternative you can check the Trial Court website, any closures will be posted on their homepage.

The Women's Law Association of Western New England University

The Women's Law Association will be hosting an event on Friday, April 4, 2014 from 4:00 pm to 6:00 pm at the Rivers Memorial Hall at Western New England University to benefit the Innocence Project.  Guest speaker, Betty Anne Waters, well known for her story being told in the movie called  "Conviction".  This event is free of charge to the community.
